| RATES, FEES & TERMS
We appreciate the opportunity to serve you with the Continental Finance MasterCard® issued by First Bank of Delaware, Wilmington, Delaware. PLEASE PRINT THESE DISCLOSURES AND KEEP THEM WITH YOUR RECORDS. This credit card account ("Account") is offered and credit cards are issued by First Bank of Delaware, Member FDIC, pursuant to a license from MasterCard International Incorporated, and Delaware law will govern the Cardholder Agreement. Provided your application is approved, the complete terms applicable to the Account and the Continental Finance MasterCard Credit Card will be furnished to you in the Cardholder Agreement. In the following disclosures, "Bank," "we," "our," and "us" refer to First Bank of Delaware and "you" and "your" refer to the person applying for an Account, each person to whom we issue a Card at your request, and anyone else who uses your Card with your consent (an “Authorized User”). The word “Card” means your MasterCard Credit Card. Below are the rates, fees and terms associated with this Credit Card offer.
*The Account Maintenance Fee of $144.00 will be billed
to your credit card in equal monthly installments of $12.00. FINANCE CHARGES. Your Account is subject to the following FINANCE CHARGES, each of which will be charged to your Account as a Purchase for the purpose of calculating Periodic Finance Charges: Periodic Finance Charges. Periodic Finance Charges are imposed on Purchases beginning on the date a Purchase is posted to your Account. However, Periodic Finance Charges will not be imposed on Purchases made in any Billing Cycle in which the Previous Balance shown on your Monthly Billing Statement is zero and you pay your New Balance in full by the Payment Due Date shown on your Monthly Billing Statement. Periodic Finance Charges are imposed on Cash Advances beginning on the date a Cash Advance is obtained and continuing until the balance of your Account is paid in full. There is no time in which you can pay the balance of Cash Advances in order to completely avoid Periodic Finance Charges. Periodic Finance Charges for both Purchases and Cash Advances are calculated at a daily periodic rate of 0.0546%, which is equivalent to an ANNUAL PERCENTAGE RATE of 19.92%. Periodic Finance Charges for a Billing Cycle are calculated by applying the daily periodic rate (shown above) to the Average Daily Balance of Purchases (including new Purchases) and Cash Advances (including new Cash Advances) multiplied by the number of days in the Billing Cycle. The Average Daily Balance of Purchases is computed by taking the beginning balance of Purchases each day, adding any new Purchases (including FINANCE CHARGES, Other Charges and fees) and subtracting any applicable payments and credits. Any resulting credit balance is treated as a zero ($0.00) balance. This gives us the daily balance. The daily balances are then added together and divided by the number of days in the Billing Cycle to get the Average Daily Balance of Purchases. To get the Average Daily Balance of Cash Advances, we use the same calculation method that we use for Purchases. The Average Daily Balance of Purchases is computed by taking the beginning balance of Purchases each day, adding any new Purchases (including Finance Charges and other fees and charges) and subtracting any applicable payments and credits. Any resulting credit balance is treated as a zero ($0.00) balance. This gives us the daily balance. The daily balances are then added together and divided by the number of days in the billing cycle to get the Average Daily Balance of Purchases. To get the Average Daily Balance of Cash Advances, we use the same calculation method that we use for Purchases. There is no minimum Periodic Finance Charge. Cash Advance Fee. In addition to the Periodic Finance Charge on Cash Advances, there is a FINANCE CHARGE of 3% or $5.00, whichever is greater, for each Cash Advance posted to your Account that month. Account Processing Fee. There is a one-time Account Processing Fee of $200.00 as a condition of extending credit to you. This fee is a FINANCE CHARGE. Authorized User Fee. Your Account will be assessed a one-time Authorized User Fee of $30.00 for each Authorized User you add to your Account. This fee is a FINANCE CHARGE. Credit Limit Increase Fee. Your Account will be assessed a Credit Limit Increase Fee of $25.00 each time that you receive a Credit Limit increase. This fee is a FINANCE CHARGE. Replacement Card Fee. If at any time you request a replacement Card due to loss, damage, theft, or destruction of your current Card, you will be charged a Replacement Card Fee of $15.00, which is a FINANCE CHARGE. Foreign Currency Transaction Fee. We will assess a Foreign Currency Transaction Fee equal to 2% of any transaction made in a foreign currency that is converted to U.S. Dollars by Visa or MasterCard. This fee is a FINANCE CHARGE. Other Charges. Your Account is subject to the following fees, each of which will be charged to your Account as a Purchase for the purpose of calculating Periodic Finance Charges: Annual Fee. Your Account will be assessed an Annual Fee of $50.00 when your Account is opened and annually thereafter on approximately the anniversary date of your Account. The Annual Fee is non-refundable except as provided in the Account Closing, Fee Refund and Account Crediting section below. Your payment of the Annual Fee does not affect our right to close your Account or to limit your ability to make transactions on your Account. Account Maintenance Fee. We will charge a monthly Account Maintenance Fee of $12.00 for your participation in your Account. This fee will be charged each month beginning with your second Billing Statement. If your Account is closed by you or us, we will continue to charge the Account Maintenance Fee until you pay your outstanding balance in full. Late Payment Fee. If we do not receive a payment from you in at least the amount of the Minimum Payment by the Payment Due Date shown on your Monthly Billing Statement, you will be charged a Late Payment Fee of $35.00. We may also refer to this fee as the late fee or late charge. Overlimit Fee. If your Account balance exceeds your Credit Limit on the Billing Cycle Closing Date, you will be charged an Overlimit Fee of $35.00, unless a FINANCE CHARGE or an Other Charge caused the Overlimit condition in that Billing Cycle. However, we will charge an Overlimit Fee in subsequent Billing Cycles, even if no new transactions are made on your Account, and your Account balance remains over your Credit Limit on the Billing Cycle Closing Date. We will not charge more than one (1) Overlimit Fee for any Billing Cycle. The charging of an Overlimit Fee shall not create any right on your part to exceed your Credit Limit or constitute a waiver by us of any rights upon your default. Returned Payment Fee. If you make a payment on your Account and your check or other payment instrument (including an electronic funds transfer or a telephone authorized draft) is not honored for any reason or cannot be processed, we will charge a Returned Payment Fee of $35.00. Courier Delivery Fee. We impose a $25.00 fee for the courier delivery of your Card sent by priority mail, if you request this service. This optional service is available on lost, stolen or replacement Cards. Duplicate Statement Fee. If you request a duplicate copy of a Monthly Billing Statement, you will be charged a Duplicate Statement Fee of $5.00, unless you request the Statement in connection with a bona fide billing error dispute. Internet Payment Fee. You may request that we arrange an internet payment on your Account. At your option, you may make a single payment over the internet rather than by mail. We will assess a $4.00 Internet Payment Fee for each internet authorized payment. Credit Availability/Payment Hold. Payments made by guaranteed funds (for example, money orders, debit cards, credit cards, cashier’s checks, MoneyGram and Western Union Quick Collect) will increase your credit availability on the day your payment is posted. For all other payments (for example payments made via a checking account or payments made via the WesternUnion Speedpay system or via the Fidelity National Information Services XPay system, both of which utilize a checking account), depending on the payment amount and/or how long your Account has been opened, and if you have previously made a payment that was not honored for any reason, such payment will not increase your credit availability until we are assured that the payment has not been dishonored. This payment hold will take at least seven (7) days. Credit Limit and Credit Availability. Your initial Credit Limit will be $300.00 and you agree to pay the following fees, which will be billed to your Account and will appear on your first monthly Billing Statement: a one-time Account Processing Fee of $200.00 and an Annual Fee of $50.00. Your available credit after these charges will be $50.00 at Card issuance. Thereafter, your current Credit Limit will appear on your Monthly Billing Statement. The maximum Credit Limit you can obtain over time is $2,000.00. You agree that we may change or cancel your Credit Limit at any time without affecting your obligation to pay the amounts that you owe under this agreement. Credit Limit Increases. Your Account will be reviewed periodically for a Credit Limit increase. Unless you opt out of automatic Credit Limit increases as provided below, you can qualify for Credit Limit increases, beginning with the sixth month your Account is open by satisfying our credit criteria at that time which may include criteria such as your record of timely payments and staying within your Credit Limit. After the first Credit Limit increase, you can receive additional increases as often as every one hundred eighty (180) days. Each Credit Limit increase will be $75.00, subject to a maximum Credit Limit of $2,000.00. Each increase will appear on your Account no later than one (1) month after you have qualified for such increase. At the time of each Credit Limit increase, a $25.00 Credit Limit Increase Fee, which is a FINANCE CHARGE, will be charged to your Account. If you do not want to be eligible for automatic Credit Limit increases, you must notify us in writing at Continental Finance, P.O. Box 8099, Newark, DE 19714-8099 or call us toll free at 1-800-518-6141. In addition, you may decline a Credit Limit increase, and avoid the $25.00 Credit Limit Increase Fee, by notifying us in writing at the address shown above, or by calling us toll free at 1-800-518-6141, within thirty (30) days of the date of the Billing Statement on which the Credit Limit increase appears on your Account, as long as you have not used any part of the increase for any Purchases or Cash Advances. We may change the criteria applied to determine your eligibility for a Credit Limit increase at any time in our sole discretion. In addition, we may elect, in our sole discretion, to modify or discontinue the practice of granting Credit Limit increases. Changes in Agreement Terms. We can change any term of this Agreement, including the rate at which or manner in which Periodic Finance Charges are calculated, at any time, in our sole discretion, upon such notice to you as is required by law. At our option, any change will apply both to your new activity and to your outstanding balance when the change is effective. IMPORTANT INFORMATION ABOUT PROCEDURES FOR OPENING A NEW ACCOUNT To assist the government in its fight to stop the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens an account. When you apply for an account, we will ask you for your name, address, social security number, date of birth and other information that will help us identify you. Certification/Authorization - You certify that all information given in your application for the Continental Finance MasterCard, issued by First Bank of Delaware Member FDIC, pursuant to a license from MasterCard International Incorporated is true and correct and you are giving this information in order to obtain credit. You authorize the Bank to obtain a credit bureau report and to verify any information you have provided in your application. You agree to furnish the Bank with all requested information. If your Continental Finance MasterCard application is approved, you authorize the Bank to charge the Account Processing Fee, the Annual Fee, the Account Maintenance Fee and any other FINANCE CHARGES, Other Charges and fees to your Account. Notices By responding to this offer you are authorizing us to obtain credit reports about you, both now and in the future, for any legitimate business purpose associated with the account or request for an account, including but not limited to reviewing, modifying, renewing or collection on your account. California Residents: A married applicant may apply for a separate Account. As required by law, you are hereby notified that a negative credit reporting reflecting on your credit record may be submitted to a credit reporting agency if you fail to fulfill the terms of your credit obligations. Kentucky Residents: You may pay the unpaid balance of your Account in whole or in part at any time. Delaware Residents: Service charges not in excess of those permitted by law will be charged on the outstanding balances from month to month. Ohio Residents: The Ohio laws against discrimination require creditors to make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with these laws. New York and Wisconsin Residents: This program is not available to New York and Wisconsin residents. |
